General Terms and Conditions of Sale
We invite you to carefully read these General Terms and Conditions of Sale before making any purchase on the website, if applicable. By making any purchase, you fully accept these General Terms and Conditions of Sale.
Please note that the purchase of products for sale involves the conclusion of a sales contract with Artonauti S.r.l. Società Benefit, Via San Calocero 2, 20123, Milan, Italy, and that the order will be processed from Italian territory.
Subject
Sales contracts concerning all products offered for sale by Artonauti S.r.l. Società Benefit (hereinafter referred to as Artonauti) and concluded remotely via electronic networks are governed exclusively by these general terms and conditions.
Parts
These general terms and conditions govern exclusively sales contracts entered into with consumers – meaning natural persons acting for purposes unrelated to any entrepreneurial, commercial or professional activity they may carry out – and Artonauti.
This means that the products and services purchased on the Artonauti website are for the consumer’s personal use only and may not be used for commercial purposes (such as resale, even in a form different from the original, either alone or in combination with other products, or as prizes in competitions and prize promotions, etc.).
Conclusion of the contract and acceptance of the general terms and conditions of sale
The contracts for the sale of products offered for sale on this website are considered concluded at the time the payment transaction is completed.
Consumer obligations
Before submitting their purchase order, consumers are required to carefully read these general terms and conditions. The submission of the purchase order implies full knowledge and acceptance of these terms and conditions.
Finally, once the online purchase procedure has been completed, the consumer is required to print and retain these general terms and conditions, which have already been viewed and accepted during the contract conclusion phase.
Purchase method
The consumer purchases the product, whose characteristics are illustrated online in the relevant descriptive or technical data sheets, depending on the product, at the price indicated therein, plus the delivery costs specified on the website and in the purchase order.
Before the purchase order is submitted, the unit cost of each selected product, the total cost in the event of multiple product purchases, and the related delivery costs are summarised.
Payment methods
The consumer can make the payment due by choosing one of the methods listed below.
Payment by credit card
Payment for purchases made by credit card can only be made by the credit card holder/owner.
If the consumer intends to pay by credit card, he may use a procedure provided by Artonauti to ensure the confidentiality of the data provided by customers. In particular, this procedure requires that credit card details be entered via a secure connection to the payment gateway, which guarantees a high level of security: Artonauti will not be aware of the consumer’s credit card number, which will be transmitted directly from the website to the payment gateway managed by the circuit bank, without being stored by Artonauti or any other party. Artonauti is therefore in no way responsible for any fraud or illegal use of credit cards used on its website.
Product delivery
The purchased goods are delivered to the geographical address indicated by the consumer. Any specific requirements must be communicated to Artonauti by the consumer.
Artonauti will deliver the product purchased by the consumer to their geographical address via express courier or postal service.
Delivery of the goods is guaranteed within 30 working days from the day following the day on which the consumer made the online payment transaction.
If the purchased item is not available, Artonauti will inform the consumer at the email address provided by the consumer (or, if not specified, at another address indicated by the consumer in the order). In the event of temporary unavailability of the goods, Artonauti will notify the consumer, who may choose to wait for the goods to become available or cancel the order and obtain a refund of the price paid. In the event of definitive unavailability of the goods, Artonauti will notify the consumer, who may choose to order different goods or cancel the order and obtain a refund.
Guarantee of conformity and defective products
Products purchased on the ‘Artonauti’ website are subject to the regulations on the sale of consumer goods contained in Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on certain aspects of the sale and guarantees of consumer goods.
The products delivered comply with the characteristics illustrated online in the relevant descriptive or technical data sheets, depending on the product purchased by the consumer.
Artonauti is liable to the consumer for any lack of conformity existing at the time of delivery of the goods.
If the delivered goods are not in conformity, the consumer is entitled to have the goods brought into conformity or replaced or, if this is not possible, to a refund of the price paid. The consumer can contact us by email providing as much information as possible about the problem encountered.
Without prejudice to the applicability of the remaining provisions contained in Directive 2011/83/EU, the aforementioned right is recognised to the consumer provided that the goods delivered have been used correctly, in accordance with their intended use and in accordance with the instructions for use accompanying the product purchased by the consumer. In particular, the aforementioned warranty does not apply to goods that have conformity defects that the consumer was aware of at the time of conclusion of the contract or could not reasonably have been unaware of.
Terms
The consumer is required to report any lack of conformity of the goods to Artonauti within 2 years of delivery and within 60 days of the date on which the defect was discovered. The consumer loses the above rights if he does not report the lack of conformity within the specified time limit.
Right of withdrawal
Please note that the consumer’s right of withdrawal cannot be exercised in relation to editorial products such as newspapers, periodicals, comics, magazines, collections of albums and stickers sealed by the consumer after delivery, offered for sale on this website.
Applicable law
This contract is governed by Italian law. The application of Italian law to this contract does not prejudice the possible application of mandatory provisions of the legal system of the consumer’s country of residence and intended for their protection.
Competent court
In the event of a dispute between Artonauti and the consumer, the competent court shall be that of the consumer’s place of residence or domicile, if located within the territory of the state.
